• Price alerts and notifications
• Market sentiment analysis from public sources
• Historical data visualization

We make no guarantees, representations, or warranties regarding:

• Stock performance or trading outcomes
• Accuracy or timeliness of market data
• Reliability of AI-generated content
• Availability or uptime of the Service
• Completeness of sentiment analysis

2.4 AI-Generated Content

Our Service uses artificial intelligence (Claude by Anthropic) to generate responses and analysis. AI-generated content may contain errors, inaccuracies, or hallucinations. You acknowledge that:

• AI responses are probabilistic and may be incorrect
• You must independently verify all information
• AI analysis should not be relied upon for investment decisions
• We are not responsible for AI-generated content

3. User Obligations

3.1 Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password
• Not share your account credentials with others
• Notify us immediately of any unauthorized access
• Accept responsibility for all account activity

4. Subscription and Billing

4.1 Subscription Tiers

• Subscriptions are billed monthly in advance
• Payments are processed via Stripe
• You authorize automatic recurring charges

• All fees are in U.S. Dollars (USD)

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You will retain access until the end of your current billing period
• No further charges will be made
• Your account will revert to the Free tier
• No partial refunds are provided for unused time

4.4 Refund Policy

We offer a 7-day money-back guarantee for first-time subscribers. To request a refund:

• Contact support within 7 days of your initial subscription
• Provide your account email and reason for refund
• Refunds are processed within 5-10 business days
• Only first-time subscriptions are eligible
• We reserve the right to deny refunds for abuse

5. Limitation of Liability

• Third-party API failures (Yahoo Finance, Reddit, etc.)

5.3 Third-Party Dependencies

Our Service depends on third-party data providers and APIs, including but not limited to:

• Yahoo Finance (market data)
• Reddit API (sentiment analysis)
• Anthropic Claude (AI responses)
• Stripe (payment processing)

We are not responsible for the accuracy, availability, or performance of these third-party services.

5.4 Maximum Liability

To the maximum extent permitted by law, our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

5.5 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Intellectual Property

6.1 User Content

You retain ownership of all content you create through the Service, including:

• Chat messages and conversations
• Watchlist configurations
• Alert settings and preferences
• Trade journal entries (Elite tier)

6.2 License to Use Content

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and process your content to provide the Service
• Use anonymized, aggregated data to improve our AI models
• Display your content back to you within the Service

We will NOT sell, share, or publicly display your personal content without your explicit consent.

6.3 Platform Ownership

We own all rights, title, and interest in the Service, including:

• Software code and algorithms
• Design and user interface
• Branding and trademarks
• Documentation and content

7. Termination

7.1 Termination by User

You may terminate your account at any time by:

• Canceling your subscription (if applicable)
• Requesting account deletion from settings
• Contacting support at support@finvi.ai

7.2 Termination by Company

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse the Service or other users
• Fail to pay subscription fees
• Compromise security or system integrity

7.3 Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• Your data may be deleted after 30 days
• No refunds will be provided (except as stated in Section 4.4)
• Provisions regarding liability and intellectual property survive

8. Dispute Resolution

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

8.2 Arbitration Agreement

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except:

• Either party may seek injunctive relief in court
• Small claims court proceedings are permitted
• Intellectual property disputes may be brought in court

8.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits or class-wide arbitration.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. We will notify you of material changes via:

• Email to your registered address
• In-app notification
• Prominent notice on our website

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Miscellaneous

10.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FinVI regarding the Service.

10.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10.3 No Waiver

Our failure to enforce any provision shall not constitute a waiver of that provision or our right to enforce it in the future.

10.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
